Terms and conditions

Plain-English terms for our two services. Highlighted figures are drafts for Jacques and Angelique to confirm; this page is not legal advice.

These terms apply to every quote, proposal and piece of work from JEA Productions (Pty) Ltd, registration 2025/233512/07 ("JEA", "we"). By accepting a quote or paying a deposit you ("the client") agree to them. Last updated 20 September 2026.

1. Who we are and what we do

JEA provides two services: marketing (paid advertising, booking funnels, websites and reporting) and branding (logo, identity, brand guides, print and digital design). Anything not written in the accepted quote is not included.

2. Quotes and acceptance

  1. Quotes are valid for 30 days. Work starts when the quote is accepted in writing and any deposit has cleared.
  2. A quote covers the scope it describes. Extra work is quoted separately before it starts.

3. Marketing services

  1. The monthly fee is fixed and billed monthly in advance. Ad spend is separate, paid by the client directly to the advertising platform from the client's own ad account.
  2. The ad account, pixel, data and audiences belong to the client. JEA works inside the client's account and is removed from it when the engagement ends.
  3. Either party may end the engagement with 30 days' written notice. Fees already paid for the current month are not refunded; no further fees fall due after the notice period.
  4. JEA does not guarantee a number of leads, bookings or sales. Results depend on the client's offer, area, budget, pricing and response time to enquiries. JEA reports actual figures from the client's own accounts every week.
  5. The client agrees to respond to enquiries and bookings promptly, keep the calendar accurate, and give JEA the access it needs (ad account, website, calendar, tracking).

4. Websites

  1. Website projects are quoted as a fixed price: 50% deposit to start, balance before the site goes live.
  2. The client owns the domain and, unless agreed otherwise, the hosting account. JEA will set both up in the client's name on request.
  3. Content, images and legal text supplied by the client are the client's responsibility. JEA does not check them for accuracy or rights.
  4. If the client goes quiet for more than 30 days mid-project, JEA may close the project and invoice for work done to that point.

5. Branding and design

  1. Branding projects are quoted as a fixed price: 50% deposit to start, balance on delivery of final files.
  2. The quote includes two rounds of changes per stage. Further rounds are charged at the hourly rate on the quote.
  3. Copyright in the final approved designs transfers to the client on full payment. Until then the work remains JEA's property. Unused concepts stay with JEA.
  4. JEA may show finished work in its portfolio and on its website unless the client asks in writing, before delivery, that it stays private.
  5. Fonts, stock images and print are third-party costs; where they apply they are itemised on the quote. Licences bought for the project are in the client's name where the licence allows it.
  6. JEA prepares print-ready files. Printing itself, proofs and print quality are between the client and the printer unless JEA is quoting for print management.

6. Payment

  1. Invoices are due within 7 days unless the quote says otherwise. UK clients are invoiced in GBP; South African clients in ZAR.
  2. Late invoices pause work and delivery. Final files, sites and reports are released when the account is settled.

7. Confidentiality and data

Each party keeps the other's business information confidential. JEA handles personal data it sees in the client's systems only for the agreed work and in line with the client's own obligations under UK GDPR or POPIA as applicable.

8. Liability

JEA's total liability for any claim is limited to the fees paid for the work in question in the three months before the claim. JEA is not liable for loss of profit, indirect loss, platform outages, account restrictions imposed by Meta or Google, or third-party services.

9. Governing law

These terms are governed by the laws of South Africa. Disputes will first be raised in writing and discussed in good faith before any formal step.
